Terms & Conditions of Use

1. General information

Pursuant to Article 10 of Spanish Law 34/2002 (LSSI-CE), the Service provider's details are:

2. Purpose

These Terms govern access to and use of Calibana (Meet Transcriber Pro), a service that lets you:

  • Capture the text of Google Meet live captions via a Chrome extension.
  • Store and review transcripts, summaries and notes.
  • Automatically generate (via AI) summaries, minutes and task lists.
  • Organize tasks on a Kanban board linked to projects and clients.
  • Optionally, show your upcoming meetings by connecting your Google Calendar (read-only).

You accept these Terms when you create an account or use any feature of the Service.

3. Access and user account

To use the Service you must be of legal age or have legal capacity to contract, provide truthful and up-to-date data, and keep your password confidential. You are responsible for all activity under your account. We reserve the right to suspend or cancel accounts that breach these Terms.

4. Plans and pricing

4.1. Free plan

Basic features, with monthly limits on meetings processed and AI uses. Subject to fair use policy.

4.2. PRO plan

Price: €10/month, VAT included where applicable. Monthly auto-renewing subscription until cancellation. Extended features as described on the current plans page. Prices may change with at least 30 days' notice; you may cancel before the change takes effect without penalty.

5. Payments, billing and taxes

  • PRO payments are processed through Stripe Payments Europe Ltd.
  • By subscribing, you authorize recurring charges to your chosen payment method.
  • We issue an electronic invoice for each charge, available in your panel ("My Subscription").
  • VAT or equivalent tax applies based on your country of tax residence.

6. Cancellation and right of withdrawal

6.1. Cancellation

You may cancel at any time from your panel. Cancellation takes effect at the end of the current billing period. No refunds are given for partial periods already started, except where required by law or under clause 11.

6.2. Right of withdrawal (consumers)

If you are a consumer, you have the right to withdraw within 14 calendar days of entering the contract, without justification (Spanish RDLeg 1/2007, TRLGDCU). To exercise it, write to legal@calibana.com. We will refund within a maximum of 14 days.

Note: as a digital service, if you start using the PRO Service during those 14 days after expressly requesting it, you lose the right of withdrawal (Art. 103.m TRLGDCU).

7. Acceptable use

You agree NOT to use the Service to:

  • Transcribe conversations you have no right to, or without informing participants where the law requires it.
  • Infringe third-party rights (secrecy of communications, honor, privacy, intellectual property).
  • Reverse engineer, decompile or access the source code.
  • Overload the infrastructure, run attacks or circumvent technical or usage limits.
  • Upload or process unlawful, defamatory or infringing content.
  • Resell or sublicense the Service without written authorization.

8. Fair use policy

Both the free and PRO plans include "fair" use of AI features. In the event of abnormal or abusive volume (mass automation, continuous calls, non-human patterns), we may temporarily pause AI access and contact you to resolve it.

9. Artificial intelligence: accuracy and responsibility

Summaries, minutes, tasks and AI-generated answers are produced via third-party models (currently Google Gemini) and may contain errors or omissions. They are not legal, financial, medical or professional advice. Always review and validate the content before using it.

10. Intellectual property

Of the Service: the extension, code, design, logos and the "Calibana" / "Meet Transcriber Pro" brand are owned by or licensed to us. Reproduction or use without consent is prohibited.

Of user content: you retain ownership of your transcripts, tasks and other content. You grant us a limited, non-exclusive, revocable license to store and process them solely to provide the Service.

11. Service availability and dependence on third parties

11.1. Nature of the Service

Calibana necessarily relies on third-party platforms and APIs over which we have no control: Google Meet (captions), Google Gemini API (AI), Google Calendar API (upcoming meetings), Supabase (data and auth), Stripe (payments), Amazon SES (email) and the Chrome Web Store (distribution). The user expressly acknowledges and accepts that the proper functioning of the Service depends on the availability and policies of these third parties.

11.2. Changes in third-party platforms

At any time and without notice, a provider may modify the operation or design of its platform (e.g. a redesign of the Google Meet captions panel), change its API terms, prices or quotas, limit or remove features, or permanently discontinue its service. Such changes may cause Calibana features to stop working temporarily or permanently.

11.3. Commitment to adapt

We commit to detecting and diagnosing incidents diligently, working on adaptation as soon as technically possible, and informing affected users of the incident status. We cannot guarantee specific resolution times, as they depend on the nature of the third party's change.

11.4. Compensation regime

  • Brief or intermittent incidents (less than 72 continuous hours without service): no right to refund, discount or compensation, as this is the ordinary risk of a cloud service based on third-party APIs.
  • Prolonged incidents (more than 7 continuous calendar days with an essential feature inoperative): the affected PRO user may request, at legal@calibana.com, a refund proportional to the time that essential feature was unusable. "Essential feature" means caption capture or AI summary generation.
  • Permanent discontinuation: if the incident is technically impossible to resolve and entails the permanent removal of an essential feature, the PRO user may cancel with immediate effect and request a refund of the proportional part of the period already billed and not enjoyed.

11.5. Exclusions

Any other compensation is excluded: loss of profit, loss of clients, loss of productivity, indirect or consequential damages arising from unavailability. This exclusion operates within the limits of clause 12 and respects mandatory consumer rights.

11.6. Changes to the Service itself

We may modify, add or remove features at any time. If changes are substantial and harm you, we will give reasonable notice and, if you are PRO, you may cancel without penalty before they take effect.

12. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect damages, loss of profit, loss of data or opportunities. Our total cumulative liability to a user is limited to the amount that user paid us in the 12 months prior to the event giving rise to the claim. These limitations do not affect mandatory consumer rights.

13. Changes to these Terms

We may update these Terms. The current version will be published at calibana.com. For substantial changes, we will notify you by email at least 15 days in advance. Continued use after they take effect means you accept them.

14. Governing law and jurisdiction

These Terms are governed by Spanish law. If you are a consumer, you may turn to the courts of your domicile or the EU online dispute resolution platform: ec.europa.eu/consumers/odr. If you are a professional or company, the parties submit to the courts of Bilbao (Bizkaia), waiving any other jurisdiction.
